Zeecreate Terms of Use Agreement

By using the website zeecreate.com ("Zeecreate"), you are agreeing to be bound by the following terms and conditions and the Zeecreate privacy policy. If you offer a product on Zeecreate for ‘free’ you are still obligated by the terms and conditions outlined here.

The Zeecreate community works together to create a good trading environment, please report any breach of our policies to our admin staff.

General User responsibilities

1. You must be 18 years and older to use this site.
2. Treat other users with respect: You must not, threaten, impersonate, intimidate or in any way distress any other Zeecreate users.
3. Do not take part in illegal activity: You may not use Zeecreate for any illegal or unauthorized purpose. Users must comply with all local laws regarding online conduct and acceptable content.
4. You are responsible for your user account: You are responsible for all actions performed under your user name. You are solely responsible for your conduct and any data, text, information, screen names graphics, photos, profiles, audio and video clips, links (“Content”) that you submit, post and display on the Zeecreate service. You are responsible for keeping your password secure.
5. No hacking: You must not modify, adapt or hack Zeecreate.com in any way as to the detriment of Zeecreate or its users.
6. No spam: You must not submit unwanted email or Conversations to any zeecreate members ("Spam").
7. No viruses: You must not transmit any worms or viruses or any code of a destructive nature.
8. You must pay your zeecreate fees within 28 days of being invoiced.

Violation of any of these agreements will result in the termination of your Zeecreate account. While Zeecreate prohibits such conduct and content on its site, you understand and agree that Zeecreate is a venue and as such is not responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Zeecreate service at your own risk.

Zeecreate conditions

• Zeecreate reserves the right to modify or terminate the Zeecreate service for any reason, without notice at any time.
• Zeecreate reserve the right to alter these Terms of Use at any time. If changes are made to these terms and conditions, Zeecreate will notify you via email.
• Zeecreate reserves the right to refuse service to anyone for any reason at any time.
• Zeecreate reserves the right to cancel any user’s membership if zeecreate feels the member is abusing the website’s services in any way.
• Zeecreate reserves the right to remove any content which is inappropriate for the site. (‘Content’ meaning any information displayed on the website by any of its users). Although Zeecreate have no obligation to remove such content, Zeecreate may remove content if the Zeecreate team sees this content as being in any way offensive, illegal or otherwise objectionable. This will be left up to the sole discretion of zeecreate.com.
• You can remove your profile at any time by deleting your account. This will also remove any private images you have stored in the system.
• Content License: By uploading content onto Zeecreate.com you are giving Zeecreate permission to host and display this content. You also give Zeecreate the right to advertise and display this content within all other types of media (this allows us to advertise the sites content elsewhere).
• If we feel that you are not using Zeecreate responsibly, or in the spirit of the community, we reserve the right to cancel your membership without refund.

Membership Eligibility

The Zeecreate service is not available for anybody under 18. If you are under 18 you must get a parent or guardian to use Zeecreate with you. To become a member of Zeecreate you must be able to form binding contracts under applicable law.

Fees and Services

· It is free to register with Zeecreate. It is also currently free to set up a webstore with Zeecreate.

· Zeecreate charges and fees are subject to change. If changed, you will be given notice via email to the email address provided on your account.

Zeecreate is a Venue

Zeecreate is not a retailer. Although often referred to as an online ‘auction’ or ‘market-place’, Zeecreate acts as a venue to allow an individual to offer, sell, and buy certain goods, within a fixed price format. Zeecreate is not involved in the actual transaction between buyers and sellers. Therefore, Zeecreate cannot ensure that a buyer or seller will actually complete a transaction. Zeecreate does not transfer legal ownership of items from the seller to the buyer.

Zeecreate has no control over:

· the quality of items listed

· the safety of items listed

· the legality of items listed

· the truth or accuracy of the listings or any other content posted by users,

· the ability of sellers to sell items or the ability of buyers to pay for items.

You accept sole responsibility for the legality of the transactions you participate in on this site. You will not hold zeecreate liable for any actions or inactions of its users.

Verifying User Identities

Because of the difficulties in verifying a user’s identity over the internet, Zeecreate cannot prove that the name and identity given on the website is accurate.

Release

Because Zeecreate is a venue, in the event that you have a dispute with one or more users, you release Zeecreate (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Information Control

Zeecreate does everything in its power to create a pleasant shopping experience. However, zeecreate does not directly control information posted onto the website through its users. There may therefore be harmful or offensive material on the website. There may also be users who are intending to use the service for illegal purposes. Please use this service responsibly. By agreeing to these terms and conditions you acknowledge and accept that there may be risks involved in using this service, which Zeecreate are in no way responsible for.

Buying

A buyer is obligated to complete the transaction of a purchase of an item on Zeecreate in any shop within three (3) working days after receipt of payment. A buyer is obligated to immediately pay in full by using Paypal.

A seller must abide by all of Zeecreate’s policies and the seller's own individual shop policies when selling an item

Listing and Selling

Listing Description: You must be legally allowed to sell the item(s) you list for sale on Zeecreate.com. You must accurately and completely describe the item(s) and the terms of sale. If you put on a listing that more than one item is “in stock” then each product must be identical. The content in the description box must be relevant to the item being sold.

Shop Policies: It is encouraged that all zeecreate webstore owners outline their own policies within their webstore, including terms of delivery and shipping and returns. Zeecreate reserves the right to modify any webstore’s policies; the seller will be contacted if this is done.

Binding Sale: All sales are binding. If the seller receives a purchase request (order) the seller is obligated to complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance, such as not receiving payment for the item in question.

Termination: Zeecreate may suspend or terminate your account, without notice, if Zeecreate suspects that you have violated any of their policies, set out in this agreement. Or if you have engaged in any fraudulent or inappropriate activity in connection with Zeecreate. Zeecreate reserves the right to do this under its sole discretion.

Manipulation of prices: Manipulation refers to any kind of intentional manipulation of prices within the buyer and seller transaction. The price must reflect the value of the product. You as the seller, are not allowed to bid, manipulate bids, or ask others to bid, with the purpose of falsely raising the price of your product. You are prohibited from altering the price in an attempt to avoid paying Zeecreate charges.

Prohibited, Questionable and Infringing Items

Zeecreate has been designed for people to be able to sell their own work. Please abide by this rule and treat the service with respect. If Zeecreate believes that you are buying and selling goods that are not hand-made or created by the seller we may evaluate your account and choose to remove listings or cancel your account.

We always try to promote trade and understand that the terms ‘created by the seller’ and ‘hand-made’ are very subjective terms. a) the product breaches any laws or legal provisions,

b) the product is in contradiction to the general values and principles of the zeecreate community.

Although Zeecreate does its best to prevent improper material being displayed on the website, zeecreate is not obligated to remove it. If you believe that there is any type of copyright infringement taking place on the Zeecreate website please contact us.

The workings of the site

Zeecreate prohibits any interference with the working of the site. This includes any action which prohibits the proper working of the site.

Feedback

Low feedback reports: If you gain low feedback then Zeecreate may evaluate your listing and may either

a) limit the number listings you are allowed

b) cancel certain listings

c) cancel or suspend your account with zeecreate

You must in no way try to manipulate your feedback reports to show an inaccurate portrayal of you transactions with other users

Breach

Zeecreate may warn other’s of your activities and/or suspend or cancel you account with Zeecreate, with no refund, if

(a) You breach any part of your agreement in these terms and conditions or any other relevant Zeecreate policies
